Terms of Service

Last Updated: January 1, 2025  ·  Effective Date: January 1, 2025

These Terms of Service ("Terms") govern your access to and use of the services, website, and products provided by Infinitum Communications LLC ("Infinitum Communications," "we," "us," or "our"), a licensed Competitive Local Exchange Carrier (CLEC) operating across multiple states. By using our services, you agree to be bound by these Terms.

1. Services

Infinitum Communications provides wholesale and retail telecommunications services including Direct Inward Dialing (DID) numbers, SIP trunking, and hosted VoIP, sourced through our CLEC licenses and carrier interconnect agreements with nationally licensed carriers across the United States.

2. Acceptable Use

You agree not to use our services for: (a) unlawful purposes; (b) transmission of spam, unsolicited marketing, or robocalls in violation of the Telephone Consumer Protection Act (TCPA); (c) fraud or caller ID spoofing; (d) any activity that violates FCC regulations or applicable state telecommunications law. We reserve the right to suspend service immediately upon suspected violation without liability.

3. E911 Service

Our VoIP services include Enhanced 911 (E911) capability. You are responsible for registering your physical service address for E911. E911 service may not function during internet or power outages. Infinitum Communications is not liable for any injury, loss, or damage arising from E911 service failure due to factors outside our reasonable control.

4. Billing & Payment

Services are billed monthly in advance. Usage charges are billed in arrears. Payments are due within 15 days of invoice date. Delinquent accounts may be suspended after 30 days. All fees are non-refundable except as required by applicable law or as stated in our Service Level Agreement.

5. Service Availability

We target 99.9% uptime for all services. Planned maintenance windows are communicated at least 48 hours in advance. We are not liable for outages caused by third-party carrier failures, internet disruptions, or force majeure events.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFINITUM COMMUNICATIONS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE PRECEDING THREE (3) MONTHS.

7. Governing Law

These Terms are governed by the laws of the State of Nevada. Disputes shall be resolved by binding arbitration in Clark County, Nevada, under the rules of the American Arbitration Association.
